Terms and Conditions for using the EVMERGE Application

The EVMERGE App is designed to provide access to the charging stations within the network.

The App can be downloaded through the application stores. The link to these can be found on 

  1. www.evmerge.com
  2. QR code placed next to network chargers.

 

Type of Network and Access

  1. Public – This is an open network of chargers integrated to EVMERGE. These chargers are visible and accessible to all users of the EVMERGE App.
  2. Public with partial restriction – This is similar to a public network, but the Asset Owner / Operator may place certain restrictions on users based on time of day, duration of usage etc.
  3. Private / Restricted – This is a closed network of chargers that will be visible only to users who have been granted access by the Asset Owner / Operator.

Pricing

The costs of charging are set by,

  1. EVMERGE on charging stations operated by us.
  2. Asset Owners / Operators on charging stations owned / managed by them.

Each charging station may have its own pricing which will be readily available to the user while navigating through the available charging stations on the App.

Payment mode

After successfully completing the charging sessions, the payment can be made either through,

  1. Credit Card / Debit Card via a payment gateway integrated to the App.
  2. RFID cards issued by Asset Owner / Operator
  3. Vouchers / prepaid cards, wherever applicable.

 

Performance of chargers

EVMERGE bears no responsibility for the charging stations (hardware) nor its performance. Our operation teams work with the Asset Owners / Operators to ensure charger uptime and fault corrections but do not bear responsibility of their actions. If a charger under the public network continues to be at fault or underperforms, we will remove it from our network.

 

Refund Policy

In the following event, the customer is eligible for a refund

  1. An amount was wrongfully calculated (calculation error)
  2. An amount was charged despite unsuccessful charging.
  3. Amount debited is different than invoiced amount.

In such cases, the user should immediately within 5 working days send an email to support@evmerge.com attaching the invoice for reference.

If found eligible for refund, the amount will be credited within 10 working days to their EVMERGE account as credit of equivalent value.

 

Reservation of charging stations

To make the charging experience more convenient, provided the reservation conditions are met, the users may be allowed to reserve charging stations at certain locations for 15 minutes prior to arrival using the reservation feature in the App. 

Reservation and cancellation charges may vary from location and users are advised to check the prices before confirming the reservation.

After the reservation is made, the reservation charge will be automatically deducted from the credit card or accepted payment mode.


Refund of successful cancellation request

All refund requests need to be submitted via email within 5 working days. In case the cancellation is accepted. Refunds will be provided within 10 days of successful approval. All refunds will be provided as credit on the account.

 

User’s Responsibilities

EVMERGE app is an application that allows for a seamless charging experience. We do not control the hardware or its performance in anyway. While using the App, the User agrees to abide by the following,

  1. Follow all instructions provided within the App or written instructions that may be placed on / by the charger.
  2. Indemnify and hold harmless RAYDN Technologies, each of the its shareholder(s), employees, subcontractors and its products from and against any and all actions, demands, claims, expenses, damages, losses, liabilities, costs, suits and proceedings (including court costs and reasonable legal fees) arising out of or in relation to
  1. Loss or damage to property or vehicle and any of its fittings due to faults arising from the EV charger.
  2. Personal injury to or death of person
  3. Any fines incurred at charging locations
  4. Non- availability of chargers
  5. Damages to chargers directly caused by the User
  6. Any disputes arising between asset owner (EV Charger owner) and User.
  7. Any disputes arising between EV Users.
  8. Any loss of time while waiting for the charging session.
  9. Any changes in tariff without notice. The asset owner has the right to change the tariff at any point and will immediately be reflected in the App. No prior notices will be provided to the Users.
  10. Any disputes with utility companies.
  1. To report any difficulties faced during charging to EVMERGE through email.
  2. To report any faults in App they have faced.
  3. To report any miscalculations or wrongful charges incurred.
  4. To ensure the EV charger is suitable for the vehicle being charged.
  5. To ensure the User has access to the EV charger they are trying to connect to.
  6. To ensure there is sufficient credit available within the account for the charging session. In case of non-payment, the matter will be referred to the Authorities. 
  7. To ensure what functions of the App are valid for each of the EV charger. 
  8. To ensure the tariff / charges for each EV charger is read and understood before usage.

 

Governing laws and jurisdiction

All efforts will be made to solve any disputes in an amicable manner. In case, we are unable to reach a solution, then the dispute shall be resolved by the Dubai courts in accordance with the laws of UAE.
