Referred to as RAYDN Technologies FZCO, a freezone entity registered in UAE. Hereafter referred to as, “the company”, “we”, “our”, or “us” in this agreement. “EVMERGE,” refers to a brand name under which the e-mobility solutions of RAYDN Technologies are offered. EVMERGE as per this agreement can be either
a. Supplier of the Charge Point Management System (Software)
b. Supplier of the mobile application (APP)
c. Supplier of the charging stations
d. Lessee of charging stations
e. Provider of the charging network
f. Operator or the charging network
g. Provider of the website
h. Provider of API’s
i. Provider of any product, or service that might be offered by EVMERGE from time to time.
j. Developer of the Charging Infrastructure
k. Installer of the chargers
User
(Referred to as “User”, “Users”, “you”, or “your”) is anyone who may either,
a. Visit the EVMERGE website
b. Interact with EVMERGE on social media
c. Download and use the EVMERGE application.
d. Subscribe to and use the EVMERGE Charge Point Management System.
e. Purchase the charging station
f. Lease the charging station
g. Charge on any of the charging stations under EVMERGE network as a registered member or guest
Account
Refers to a unique account created for the user to access the services offered by us.
Asset Owner
Refers to the owner of the charging station
Cookies
Are small packets of data that are used to collect information, enhance user experience on a website or App and serve other purposes
Country
Refers to United Arab Emirates, Saudi Arabia, Oman, Qatar, Bahrain, Kuwait, India
Device
Refers to Computer, tablet, laptop, smartphone, or any other gadget that can access the products and services offered by us.
Services
Refers to the following,
a. Website owned by us (www.evmerge.com)
b. Mobile application owned by EVMERGE
c. Backend application owned by EVMERGE
d. Supply and installation of charging stations
e. Leasing of charging stations
f. Operations and Maintenance of charging stations and software
g. Licensing of the EVMERGE software
Service Providers
Refers to an individual or legal entity that processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Services, to provide the Services on behalf of the Company, to perform services related to the Services, to integrate with our products to provide the services, to provide products or services that will enable us to provide our services or to assist the Company in analyzing how the Services is used.
Product and Service Partners
Refer to legal entities who may sell their products and services to us, for us to provide the services to the users.
Business Partners
Refers to businesses who partner with us to provide deals, discounts, rewards etc as part of the loyalty program.
Personal Data
Refers to any information that relates to an identified or identifiable living individual
Operator
Refers to anyone who operates the charging station as or on behalf of the Asset Owner.
Usage data
Refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself
Types of Data Collected
Personal Data
While using Our Services, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include but is not limited to email address; first and last name; phone number; address, city, Government issues ID’s; company details (if applicable), vehicle number and details.
Usage Data
Usage data is collected automatically while our services are being used.
When accessing our services through a device, the information collected may include your device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
We may also collect information that your browser sends whenever you visit our Services or when you access the Services by or through a mobile device.
When using our EVMERGE APP, we will be collecting information pertaining to the charging session.
Tracking Technologies and Cookies
We use Cookies to track the activity on our Services and store certain information.
You can instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use some parts of our Services.
Use of your personal data
The Company may use Personal Data for the following purposes:
a. To provide and maintain our Services, including to monitor the usage of our Services
b. To manage Your Account: to manage Your registration as a user of the Services. Ability to charge at a particular charging station may be granted based on the account you have subscribed to or the access granted by the asset owner.
c. For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with us through the Services.
d. To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
e. To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
f. To manage Your requests: To attend and manage Your requests to Us.
We may share your personal information in the following situations:
a. With Asset owners and Operators
b. With Services Providers: We may share Your personal information with Services Providers to monitor and analyse the use of our Services, to contact You.
c. For Business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company.
d. With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honour this Privacy Policy.
e. With Product & Services and Business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.
Retention of your personal data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of Our Services, or we are legally obligated to retain this data for longer time periods (for example VAT).
Personal user data is retained indefinitely but will be deleted within 90 days of contract termination or account deletion. Users can delete their account from within the app.
Transfer of your personal data
Your information, including Personal Data, is processed at the Company's offices and in any other places where the parties involved in the processing are located (Amazon web servers). It means that this information may be transferred to—and maintained on—computers located outside of Your city, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.
Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.
The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.
Disclosure of your personal data
Business Transactions
If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
